Welcome to Nuance, a mobile application provided by Nuance App Pte. Ltd. ("Company," "we," "us," or "our").
By using the Nuance mobile application (the "App"), you agree to be bound by this End-User License Agreement ("EULA"). Please read it carefully.
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by this EULA and our Privacy Policy. If you do not agree to these terms, do not use the App.
2. Age Restriction
The App is intended for users who are at least 17 years old. By using the App, you confirm that you are at least 17 years of age. The App's age rating reflects 17+.
3. User Conduct
You agree not to:
a) Use the App for unlawful purposes or violate any laws or regulations.
b) Submit content that is offensive, inappropriate, or infringes any rights.
c) Engage in any form of harassment, hate speech, or abusive behavior.
d) Interfere with the App's functionality or security.
4. Content Moderation
a) We have implemented a method for filtering objectionable content.
b) Users can flag objectionable content through the in-app reporting mechanism.
c) Users can block abusive users through the App's user settings.
d) Users have the ability to immediately remove posts from their feed.
e) We will act on objectionable content reports within 24 hours by removing the content and ejecting the user who provided the offending content
.5. Reporting Inappropriate Activity
Users can report inappropriate activity through the App. Our contact information for reporting such activity is: raph@nuanceapp.co
.6. Zero Tolerance Policy
We maintain a zero-tolerance policy for objectionable content and abusive users. Any user found to be in violation of this policy may have their account terminated and access to the App revoked.
7. Intellectual Property
All rights to the App, including its content and code, are owned by Nuance App Pte. Ltd. You may not copy, modify, distribute, or reverse engineer any part of the App.
8. Privacy Policy
Your use of the App is governed by our Privacy Policy, which outlines how we collect, use, and protect your data. [See here]
9. Limitation of Liability
To the fullest extent permitted by applicable law:
a) Nuance App Pte. Ltd. is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or revenue.
b) Our total liability to you shall not exceed the greater of $100 or the amount you paid us in the past six months.
10. Disclaimer of Warranties
The App is provided "as is" and "as available." We disclaim all warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
11. Changes to EULA
We may update this EULA from time to time. If we make significant changes, we will make it clear in the update. Your continued use of the App signifies your acceptance of the updated EULA.
12. Dispute Resolution
a) Governing Law: This EULA is governed by the laws of Singapore.
b) Mandatory Arbitration: Any disputes arising out of this EULA or your use of the App shall be resolved through binding arbitration by the Singapore International Arbitration Centre ("SIAC").
c) Class Action Waiver: You waive your right to participate in any class action lawsuit or class-wide arbitration.
